General Terms and Conditions
Orthoface BV
Version 1.0 – 13 September 2026. These terms and conditions apply to all services provided by Orthoface BV and are without prejudice to the mandatory provisions of the Act of 22 August 2002 on patients’ rights, the Act of 23 May 2013 and the Code of Medical Ethics.
1. Identity of the service provider
Orthoface BV, with its registered office at Jef De Belderlaan 9, 9831 Deurle (Sint Martens-Latem), registered with the Crossroads Bank for Enterprises and registered for VAT under number BE 0892.661.801 (hereinafter “Orthoface”).
Medical services are provided by Prof. Dr. Maurice Y. Mommaerts, a specialist in maxillofacial surgery, RIZIV/INAMI number 1/34530/09/520, registered with the Belgian Order of Physicians, Provincial Council of Antwerp. His specialist professional qualification was obtained in Belgium.
Consultations take place at Face Ahead Clinic. Procedures are performed at the healthcare facilities with which Orthoface collaborates. Contact: info@mauricemommaerts.eu, +32 3 5001007
2. Scope
These terms and conditions apply to every consultation, examination, treatment and procedure performed by or on behalf of Orthoface, as well as to every quotation, cost estimate and invoice. By making an appointment, the patient accepts these terms and conditions.
Any deviations are valid only if agreed in writing. In the event of a conflict between these terms and conditions and mandatory legislation or the Code of Medical Ethics, the latter shall prevail. The provision concerned shall then be deemed amended to the extent legally permissible, without affecting the remaining provisions.
3. Nature of the obligation
The physician undertakes an obligation to exercise due care, rather than an obligation to achieve a specific result. He undertakes to provide the care that may reasonably be expected of a careful and diligent medical specialist in comparable circumstances.
No aesthetic or functional outcome is guaranteed. Healing, scarring, swelling and the final result vary from person to person and are influenced by factors including anatomy, age, skin quality, lifestyle, smoking habits and compliance with postoperative instructions. Images of previous patients and any simulations are for illustrative purposes only and do not constitute a promise of a comparable result.
4. Information and informed consent
Before any intervention, the patient is informed of the nature and purpose of the procedure, its expected consequences, the relevant risks and side effects, reasonable alternatives including no treatment, the anticipated aftercare and recovery period, and the financial implications.
Consent is given freely and on an informed basis and may be withdrawn by the patient at any time without giving a reason, including after a cost estimate has been signed.
5. Additional rules for aesthetic procedures
Additional obligations apply to procedures covered by the Act of 23 May 2013. A written report containing the information required by law, including a cost estimate, is prepared and signed by both parties.
A statutory cooling-off period of at least fifteen days must elapse between the signing of that report and the scheduled aesthetic surgical procedure. During that period, Orthoface neither requests nor accepts any consideration or financial commitment for that procedure, with the exception of fees for the preceding consultations. No advance payment is therefore requested.
Procedures with a therapeutic or reconstructive purpose are not subject to this regime. The physician assesses and documents, on a case-by-case basis, whether a procedure is therapeutic or purely aesthetic in nature.
Aesthetic surgical procedures are not performed on persons under the age of eighteen.
6. Professional fees, costs and VAT
Orthoface does not adhere to the RIZIV/INAMI agreed fee schedule. Professional fees are set independently and communicated before treatment. For procedures, the patient receives a written cost estimate.
A cost estimate is an estimate and not a fixed price, unless expressly stated otherwise. If a medically necessary change or extension arises during treatment, the patient is informed as soon as possible and the implications for the cost are discussed.
Unless expressly stated otherwise, professional fees do not include the costs of the healthcare facility, anaesthesia, implants and medical devices, diagnostic imaging, laboratory tests, medicines, dressings and compression garments. These are invoiced separately, where applicable directly by third parties.
Procedures without a therapeutic or reconstructive purpose are subject to VAT at the applicable rate and are not eligible for reimbursement under compulsory health insurance. Procedures with a therapeutic purpose are subject to the usual rules on exemption and reimbursement; the patient is informed accordingly.
No outcome-dependent remuneration or success fee is charged.
7. Payment and payment by instalments
Invoices are payable within 7 days of the invoice date, unless otherwise agreed in writing.
At the patient’s written request, payment of an outstanding invoice by instalments may be permitted. Any such arrangement is recorded in writing, specifying the instalment amounts and due dates, applies exclusively to services already provided, and carries no interest, costs or surcharges. The arrangement is a payment facility and does not constitute the provision of credit. Orthoface does not act as a lender and does not collaborate with credit providers to finance procedures.
In the event of late payment by a patient acting as a consumer, a free reminder is first sent, providing a payment period in accordance with Book XIX of the Belgian Code of Economic Law. Only after that period may late-payment interest and fixed compensation be charged, subject to the statutory limits. Any dispute concerning an invoice must be reported in writing within fourteen days of receipt.
8. Appointments, cancellations and non-attendance
The patient must notify Orthoface as soon as possible and at least two weeks in advance if an appointment cannot be attended. In the event of late cancellation or non-attendance, a reasonable fee may be charged to cover the reserved time. This fee is not payable in the event of force majeure or a medical reason.
The patient may cancel a scheduled procedure at any time. No cancellation fees that would restrict the patient’s freedom of choice are charged. Non-recoverable costs already charged by third parties may be passed on to the patient, provided the patient was informed of this in advance.
Orthoface may postpone a procedure when required for patient safety, including in the event of an intervening illness or abnormal preoperative test results, when the physician considers that the patient’s expectations do not correspond to the outcome that can realistically be expected, or when the operating schedule or hospital timetable does not allow the procedure to take place.
9. Aftercare and revision procedures
The postoperative follow-up appointments included with the procedure are specified in the cost estimate. The patient undertakes to attend these appointments.
There is no automatic entitlement to revision or corrective surgery. Its appropriateness is assessed on medical grounds. The conditions under which a revision may take place and any associated costs are discussed in advance and recorded in writing. Third-party costs, such as those of the healthcare facility and anaesthesia, remain payable by the patient in all cases.
10. Patient obligations
- provide complete and accurate information about medical history, allergies, medication, dietary supplements, smoking habits, and alcohol or substance use;
- follow preoperative and postoperative instructions, including smoking cessation, adjustments to medication and activity restrictions;
- attend the agreed follow-up appointments and make contact without delay in the event of unusual symptoms.
Failure to comply with these obligations may adversely affect the outcome and increase the risk of complications.
11. Liability and insurance
Orthoface and the physician have professional liability insurance with Vanbreda Risk & Benefits, Antwerp.
Complications are inherent in any medical or surgical treatment and do not, in themselves, constitute a fault. Liability is limited to the amount paid out by the professional liability insurer in the case concerned. Nothing in these terms and conditions limits or excludes liability where mandatory law prohibits this.
12. Patient records and processing of personal data
A medical record is maintained for each patient. Orthoface BV acts as the data controller within the meaning of the General Data Protection Regulation. Personal data are processed for the purposes of providing care, follow-up, invoicing and compliance with legal obligations.
The patient’s medical record is retained for the legally prescribed period. The patient has the right to access and obtain a copy of their record, to have inaccurate data corrected, and to exercise any further rights granted by law. Requests should be addressed to info@mauricemommaerts.eu.
The patient may lodge a complaint with the Belgian Data Protection Authority.
13. Images
Clinical photographs and diagnostic images form part of the patient’s medical record and are necessary for planning and follow-up. Images are used for teaching, scientific publications or the website only with the patient’s written consent. This consent is separate from consent to treatment, is never a condition of treatment, and may be withdrawn at any time in respect of future use.
14. Complaints and disputes
Patients who are dissatisfied are asked to first raise their concerns directly via info@mauricemommaerts.eu so that a solution can be sought. For care provided in a hospital, the patient may contact that hospital’s ombudsman service. Complaints concerning medical ethics may be addressed to the Provincial Council of the Belgian Order of Physicians.
The legal relationship between Orthoface and the patient is governed by Belgian law. Disputes fall within the jurisdiction of the courts of the judicial district of Oost-Vlaanderen, without prejudice to the right of a patient acting as a consumer to bring proceedings before the court of their place of residence.
15. Changes to these terms and conditions
Orthoface may amend these terms and conditions. The version in force at the time the appointment is made shall apply. The current version is always available on the website.
